Defendant’s BMW rear ended Plaintiff’s SUV in a low impact motor vehicle accident. Plaintiff claimed $21,572.57 in medical bills and asked for $160,000 in general damages. Prior to trial to avoid further litigation, Defendant offered Plaintiff $35,000 plus $8,000 PIP. Defendant rejected the offer and would not accept less than $50,000 plus PIP. At trial, partner Josh Hayward called a medical expert who testified that at most only three months of treatment was related to the accident.
