Read the full article included below: Your client has been sued in federal court. When you receive the complaint, your initial thought may be to prepare an answer, admitting or denying the allegations, automatically assuming you will subsequently conduct discovery and then look to settle the case. However, there are a number of important things to consider before responding, because the way you respond could change the entire course and outcome of the case. For instance, imagine that instead of filing an answer, you successfully moved to dismiss part of the plaintiff’s claim. This, in turn, significantly reduced the amount of discovery needed and therefore reduced not only your client’s, but the opposing plaintiff’s, attorney fees and costs. As a result, the plaintiff was willing to settle for a lower amount, and the case was resolved early on. Significant time and costs were saved for everyone. Seven Attorneys Graduate from Smith Freed Eberhard’s Black Belt Trial Advocacy Training Program Smith Freed Eberhard is pleased to announce the graduation of seven attorneys from the firm’s Black Belt Trial Advocacy Training Program: Sean Conner, Chelsea Glynn, Tyler Howell, Gordon Klug, Stephan Sherman, Edward Wallace, and Jessica Wilcox. The Black Belt Trial Advocacy Training Program was developed by the firm in order to give its attorneys access to trial skills, experiences, and coaching from some of the top trial lawyers in the state. In today’s legal environment, settlement, mediation, and arbitration have become commonplace. Litigators who wish to become battle tested trial lawyers have limited opportunities to develop and test their trial skills. The Black Belt program seeks to fill that gap by equipping attorneys with the tools they need for success. It teaches them how to effectively communicate, hones their presentation techniques, and helps them to develop relatable trial themes. The rigorous training process is more than just filling out an application and sitting through a couple lectures. There are currently less than 100 paralegals in the State of Oregon with this distinction. Elizabeth and Julie passed a series of exams that included Substantive Law, Legal Research, Judgment and Analytical Ability, and Ethics and Communication. Julie works primarily on the team of Partner Bruce Gilbert, and Elizabeth works primarily on the team of Partner Cliff Wilson.
